Terms of Use
Version 2.0 · in force since 20 August 2026
By using the Alayah platform (at alayahsystem.com) you accept these Terms. Please read them before using it.
This is a courtesy translation. If anything differs, the Portuguese version prevails.
These Terms govern two different relationships
The provider subscribes to the platform and uses it to run their diary. The subscription contract is with Alayah.
The client uses the platform to book a service. In that case the service is contracted with the provider, not with Alayah — prices, cancellations, refunds and the quality of the service are the provider's responsibility.
1. Who operates the platform
The platform is operated by Mayara Rosa dos Santos, a sole trader, under the Alayah brand.
- Portuguese tax number (NIF): 246 342 439
- Address: Av. 25 de Abril de 1974 40A, 2795-227 Linda-a-Velha
- Country: Portugal
- E-mail: mayara@alayahsystem.com
- Website: alayahsystem.com
2. Purpose and scope
Alayah is a booking-management and communication system between the provider and their clients. It allows you to:
- Book services with the provider, online
- See the history of your own bookings
- Receive confirmations and, where authorised, reminders and messages from the provider
- Exercise your data protection rights
Access to the management areas (/admin, /pro, /dashboard) is reserved for the authorised staff of each subscribing provider — each provider sees only their own data.
3. Account and credentials
Some features require signing in. Account holders undertake to:
- Give truthful information and keep it up to date
- Keep credentials confidential and not share them
- Report any suspected unauthorised access immediately
4. Acceptable use
The following is prohibited:
- Accessing or attempting to access areas or data belonging to other users or other providers
- Making false bookings or bookings intended to disrupt the provider
- Using automated means (bots, scrapers) to access the platform
- Attempting to compromise the security of the service
- Using the platform for spam, harassment or unsolicited messages
- Reproducing or distributing platform content without authorisation
- Impersonating another person or a member of the provider's staff
5. Breach
Where these Terms are breached, Alayah may:
- Suspend account access, with prior notice and a statement of reasons — except where immediate suspension is essential to protect the security of the service or third-party data, in which case the reason is given as soon as possible
- Close the account in cases of serious or repeated breach, after notice and an opportunity to respond
- Temporarily restrict access for security reasons
- Report to the competent authorities conduct that may constitute a criminal offence
- Claim compensation for damage actually caused and proven, under the general law
Closing an account does not mean immediate deletion of the data: the retention periods and rights set out in the Privacy Policy continue to apply. Bookings already confirmed remain, unless cancelled by the provider under point 6.
6. Bookings, cancellations and refunds
The service is provided by the provider, and it is with them that the client contracts. Cancellation, rescheduling, pricing and refund terms are those set by the provider, who must inform you of them in advance. Alayah only records and passes on the booking.
When booking, the client:
- Confirms the intention to attend on the date and at the time chosen
- Accepts that the provider may restrict further bookings after repeated no-shows without notice, under the policy the provider has set and communicated
The provider may cancel or change bookings on justified grounds, giving as much notice as possible and offering an alternative.
7. Intellectual property
The software, design, texts, images and code of the platform belong to Mayara Rosa dos Santos and are protected by copyright law. Reproduction, distribution or commercial use without written authorisation is prohibited.
Content uploaded by each provider — logo, photographs, service descriptions — remains theirs; by uploading it they grant Alayah the licence strictly necessary to display it on their own page.
8. Availability and liability
Alayah works to keep the service available and secure, but does not guarantee uninterrupted operation. It is not liable for:
- Interruptions for scheduled maintenance, announced in advance wherever possible
- Connectivity or equipment failures beyond its control
- Acts of third parties affecting the availability of the service
- The delivery, quality, price or cancellation of the service, which are the provider's responsibility
In its relationship with subscribing providers, Alayah's liability for damages is limited to the value of the subscription for the 12 months preceding the event. This limit does not apply to wilful misconduct or gross negligence, to damage to life or physical integrity, or to any liability that the law does not allow to be excluded or limited — in particular towards consumers.
9. Data protection
The processing of personal data is described in the Privacy Policy. As regards client data, the controller is the provider and Alayah is the processor; the relationship between them is governed by the Data Processing Agreement (DPA), under Art. 28 GDPR.
You may exercise your rights on the Right to Erasure page or through the contact in point 1.
10. Changes to these Terms
These Terms may be updated. Changes are notified to account holders by e-mail at least 15 days in advance, except where they follow from a legal requirement or an urgent security need.
Anyone who does not agree with the new conditions may close their account before they take effect, without penalty. Continued use after they take effect counts as acceptance.
11. Complaints and dispute resolution
About the service received — reception, price, quality, cancellation — complaints go to the provider, who holds the statutory Complaints Book, also available electronically at livroreclamacoes.pt.
About the platform, use the contact in point 1. We will look for an amicable solution.
Under Art. 18 of Portuguese Law 144/2015, in the event of a consumer dispute you may turn to the following alternative dispute resolution body:
Scope: Lisbon Metropolitan Area
www.centroarbitragemlisboa.pt
Outside the Lisbon Metropolitan Area the competent body is the Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (CNIACC) — www.cniacc.pt. The full official list is at consumidor.gov.pt.
12. Governing law and jurisdiction
Portuguese law applies. Where the user is a consumer, the court of their domicile remains competent and nothing in these Terms deprives them of the rights the law confers.
In relations between Alayah and subscribing providers, failing agreement, the competent court is that of the provider's domicile.
